APCOA Connect Ireland Service Terms and Conditions

  1. Terms
    1. The APCOA Connect Ireland service is provided by APCOA Parking Ireland Limited whose registered office is at 18A Beckett Way, Park West Business Park, Dublin 12, D12 A9KW. It is registered in Ireland with company number 282652.
    2. The following terms and Conditions ("Terms") apply to all use of the APCOA Connect Ireland Services. By registering with us or using the APCOA Connect Ireland Services, you agree to be bound by them, so please read them carefully before going any further. Future payment options via Internet services may require further registration.
    3. We are constantly seeking to improve our services and these Terms may therefore be subject to change from time to time. You agree to be bound by any changes, which shall be advised to you by publication here, and shall take effect immediately. If you do not agree with the changes, you may terminate your use of the Services. These Terms were last updated on 18th June 2024.
    4. The APCOA Connect Ireland Service provides a method of remote payment for parking services using credit or debit cards or, if selected by you, the E-Wallet facility.
    5. The APCOA Connect Ireland Service is not a contract for parking services or a parking session; it is a means of payment for those. Your contract for parking is still made with the provider of parking services at the location at which you are parking (the "Parking Site"), as advised to you there. The APCOA Connect Ireland Service is only available at certain locations and we do not guarantee its availability.

  2. How to Use the Services
    1. The APCOA Connect Ireland Services allows payment Online, by Smartphone app or by SMS messaging. To use the APCOA Connect Ireland Service for the first time, you should register online, or you can do this each time you use APCOA Connect Service without registering. You will not be able to pay by SMS unless you register with the APCOA Connect Ireland Services (see below).
    2. The registration process will guide you through the steps necessary to take your parking payment and ask you for your payment card details. Once your payment has been authorised, you will be asked whether you wish certain details to be retained ("Registration"). If you agree, these details will be held securely and used as a template for any further parking payments you make (see "Registration" below). If you register you will not have to repeat this information again on making further payments.
    3. Once you have registered with the APCOA Connect Ireland Service using a mobile phone (your "Mobile"), you may make further payments, for parking at the Parking Site for which you have registered, by SMS by sending a message from the Mobile to 086-1801630 as follows:

      1. "PARK C" with C as your CVV to repeat your last purchase
      2. "PARK C P" with C as above and P as your duration in minutes
      3. "PARK C P L" with C and P as above and L as the 4 digit location code
      4. "PARK C P L V" with C, P, and L as above and V as your vehicle registration mark.

    4. Payments made by SMS can be confirmed via an SMS reply message which will include payment confirmation if you have opt-in for this chargeable service. If you have not used the APCOA Connect Ireland Service before or you are not a registered user, you will be asked to text back with your vehicle registration number before receiving a confirmation message. The text requesting the vehicle registration is currently provided free of charge. Please note all SMS messages sent by you will be subject to your carriers usual charges. If you have current valid parking, purchased via SMS, you may extend your parking session by sending an SMS from the Mobile to 086-1801630 as follows:

      • "MORE 123 120"(where "123" is your CVV payment card security code and 120 = 120 minutes as a duration). This will add the duration specified to your existing parking).
      • Your purchase will be confirmed as per a normal "park" message.

    5. Once you have registered you can only change your account setting via the website, or the Smartphone app.
    6. If you send us duplicate SMS messages we will ignore any duplicates. Duplicates are defined as defining the same parking session (combination of location, duration, period and vehicle for the same mobile).
    7. We also offer an opt-in reminder service which alerts you to the expiry of your parking time by an SMS message sent to your Mobile. Using the website you may configure your account such that you receive reminders:

    8. It is only possible to have one outstanding reminder at once. If you currently have an existing reminder you cannot have another until the current reminder expires.

      If you choose to receive a reminder this will be sent shortly before your parking is due to expire.

      If you have a reminder for parking that you have purchased and you extend your parking before the reminder is sent, your reminder will be effectively moved to the extension of your parking.

  3. Payment and Charges
    1. By using the APCOA Connect Ireland Service, you authorise us to debit your chosen payment card or you E-Wallet to purchase parking at the Parking Site on your behalf.
    2. Payment for the parking duration requested at the Parking Site will be taken directly from the payment card you have opted to use or from your E-Wallet.
    3. The amount of the payment taken will be for the appropriate parking charge displayed at the Parking Site together with the current convenience fee in force at the location where you have parked and if you have opted to receive one, the cost of an SMS reminder. The convenience fee is to cover the provision of the APP and the service support desk.
    4. You agree that APCOA Connect can, at the frequency set out in the Annex, deduct the E-Wallet Service Charge for as long as you continue to operate that facility.
    5. If the amount is to be paid from your chosen payment card, the full payment will appear on your card or bank statement with the description "APCOA Parking Ireland".
    6. Information on the relevant parking tariff and APCOA Connect convenience fee is displayed at each Parking Site covered by the service.
    7. If a payment request is declined by your card issuer or bank and/ or there are insufficient funds in your E-Wallet, you must pay for your parking via an alternative payment card, arrange an immediate top-up of the funds in your E-Wallet or pay in cash at the nearest meter. The APCOA Connect Service accepts all major credit and debit cards. A full list of these is available on [www.apcoaconnect.ie] (the "Website").
    8. It is your responsibility to ensure that your purchase has been successful and confirmed. This will be communicated, depending on circumstance, by SMS(if you have opted-in to receive SMS confirmations) or via the Smartphone app. Confirmation is when you have been told when your parking will expire and that your parking session will not have been purchased. You may be told during the process that your payment has been taken but your parking is not confirmed until we have told you the expiry time of your parking. When purchasing by SMS and if you have opted out of receiving confirmation messages, then you can access your account online to view your purchase and expiry times.
    9. Electric Vehicle charging payment - An authorisation will first be carried out on your card.Following completion of the charging session the cost of it shall be deducted from your card with any surplus being released.

  4. Registration
    1. The APCOA Connect Ireland Service operates in a highly secure environment, employs security safeguards and conforms to rigorous financial security standards in order to ensure the integrity of the service and the safety of your details. As a registered user your details will be available only for the approved purpose of services and, if you have opted-in to the update service, updates provided by the APCOA Connect Ireland Service. No other use is permitted or allowed.
    2. You may review and edit your registered details by visiting the Website and following the instructions there. Details of your parking via the APCOA Connect Ireland Service will also be available for review together with the option to print VAT receipts. In addition you will be able to opt-in to the Reminder service and, should you wish, close your account.
    3. On accessing your details via the website you will be issued with a password which will be sent only to the mobile phone you have registered with the APCOA Connect Ireland Service (the "Password"). You may change your Password by accessing the relevant facility within the website. You agree to keep your Password and the associated mobile phone safe and secure and not to share, provide or otherwise communicate this information to another individual for any purpose.
    4. You will be responsible for all use of your details held by the APCOA Connect Ireland Service authorised or unauthorised. If you have any reason to suspect that unauthorised use of these details, including the payment card details, has been made you should inform us immediately by contacting us initially via the Contact Us form on this website and we will call you back. If you have reported your payment card as stolen to the card issuer then the usual safeguards provided by applicable laws in the country concerned will apply. We may choose to suspend your account. You should take appropriate action to amend your details to reflect any change in payment card details before attempting to use the APCOA Connect Ireland Service again.
    5. If you believe there is a security risk to Your Account, please let us know by contacting us. If you believe your mobile phone has been stolen or misused you should inform us as above as soon as possible in order to limit any further use of the phone in connection with your registered details and in order to restrict any financial implications you may suffer as a result. We cannot be held responsible for any implications associated with the use of or communications with your registered mobile phone in these circumstances.
    6. We reserve the right to refuse to register you and/or to suspend and/or terminate your Account if we believe that you have or may breach these Terms or if required by law to do so and we shall not be obliged to provide you with any reasons for so doing. We may further suspend your account if we suspect unauthorised use or abuse.

  5. E-Wallet
    1. If you have chosen to create and use an E-Wallet in connection with your APCOA Connect Account, then in addition to these terms and conditions you should refer to the Annex to these terms where details concerning the operation of that service are set out.

  6. Availability of the Service
    1. The APCOA Connect Ireland Service is only available at selected Parking Locations. For a full list of current Parking Locations you should refer to the website.
    2. You confirm that we shall not be liable to you or any third party for any modification to, suspension of or discontinuance of the Services. We make no warranties or representations with respect to the Services other than as expressly set out in these General Terms. We make no warranty or representation that the Services will be uninterrupted or error free and we shall not be liable in any way to you for the consequences of any interruptions or errors.
    3. We do not guarantee continuous uninterrupted operation of the APCOA Connect Ireland Service in connection with all locations or any individual location covered by the APCOA Connect Ireland Service. You accept and agree that this is the case and interruptions may occur for technical or other reasons which are beyond our control. We will restore the any affected services as soon as reasonably possible.

  7. Security Policy
    1. We take the security of all your personal details very seriously. Our systems are rigorously tested and have been developed with encryption software and secure socket layer technology. All banking details and transactions are also protected by firewalls with a view to ensuring the security of all personal information and your complete peace of mind. Use of your payment card data complies with the Payment Card Industry Security Standards Council Data Security Standard (PCI DSS).
    2. You agree that you will not do anything which results in any misuse or abuse of the APCOA Connect Ireland Service, including without limitation attempting to gain unauthorised access to the Website, or any part of our systems; or knowingly introduce any virus, worm or other malicious or technically harmful material.
    3. We make every effort to ensure the information on the Website is correct at all times to the best of our belief. However, we will not be liable for the accuracy of such information, although we will use reasonable efforts to correct any mistakes as soon as we become aware of them.
    4. You confirm to us that all information you provide us in connection with the Connect Service will be correct and complete and in particular that you are the person registered as the keeper of or are authorised by them to use and register any vehicle (including its registration mark) for the purposes of the Connect Service.

  8. Disputes
    1. Complaints may only be raised within 12 weeks of the date of a payment. All complaints should be raised to the car park operator. If the complaint is not resolved by the car park operator, Online Dispute Resolution (ODR) can be used atOnline Dispute Resolution (ODR)(citizensinformation.ie)

  9. General
    1. The copyrights, database rights and other intellectual property rights ("IPR") in the materials displayed on or via any of the APCOA Connect Ireland Service ("Materials", which expression includes text, data, graphics, photographs, videos, animation, images and audio visual content) is owned by or licensed to us. This IPR is protected by the laws of the jurisdiction in which the use of APCOA Connect occurs, international treaties and all other applicable copyright and intellectual property laws. You agree to respect our IPR and those of third parties. You agree that the Materials are for your personal use only. You shall not use, copy or modify any Materials or give them to other people for commercial, investment or public purposes. Your use of APCOA Connect Ireland Services gives you no rights in relation to the IPR in the Materials save as explicitly specified herein.
    2. Our maximum liability to you for any claim arising in connection with the Services shall be the cost of parking product purchased. The APCOA Connect Ireland Services provides a means of payment only, and you agree that we shall not be liable to you for any loss or damage you may suffer by using parking facilities at any Parking Location.
    3. To the fullest extent permitted by applicable law you agree that we shall not be liable for any consequential, incidental or indirect loss or damages in contract, tort or otherwise, for any loss or damage whatsoever arising from or in any way connected with your use of the Services, including, without limitation, damage for any loss in business projects, loss of profits, loss of privacy, consequences of your use that were beyond our reasonable control, or other consequential losses arising in contract, tort or otherwise from the use of or the inability to use the Services.
    4. Nothing in these Terms shall restrict our liability for:
      1. fraudulent misrepresentation;
      2. death or personal injury resulting from our negligence or that of our agents or officers; or
      3. your statutory rights (including a right to receive a reasonable standard of service).
    5. You may not transfer your account or these Terms to any other party without our agreement. You agree that we may transfer these Terms and your account without your agreement.
    6. These Terms constitute the entire agreement between you and us in relation to the Services. If any provision of these Terms is or becomes illegal, void or invalid that shall not affect the legality and validity of the other provisions.
    7. These Terms shall be governed by and construed in accordance with Irish Law and, subject to the Disputes section above, shall be subject to the exclusive jurisdiction of the Irish courts.

ANNEX

E-Wallet Operating Terms


  1. In this section we use some terms which have a special meaning in this context. These are as follows:

  2. "Closure Fee"
    the administration fee of 5 euros (plus VAT) payable when you close your E-Wallet.


    "E-Wallet Service Fee
    the monthly service fee that you pay to APCOA Connect of 50 cents per vehicle (plus VAT) up to a maximum of 2 vehicles. This can be changed at any time by APCOA Connect but only after giving you one months prior notice.


    "Low Balance Level"
    means the low balance level selected by you when you register for the E-Wallet facility. You can alter this online in your APCOA Connect settings. It cannot be below the Minimum Balance shown below.


    "Mandate"
    a direct debit or other continuous authority mandate authorising the payment to APCOA Connect of a sum of money


    "Method of Payment"
    a payment made by either using your Mandate or by one of the Other Methods.


    "Minimum Balance"
    the minimum balance of €5.00 (Euros), or such other amount as may be determined by APCOA Connect and notified to you from time to time. You must maintain the Minimum Balance in your Account at all times.


    "Other Methods"
    a payment made by credit card, debit card or cash.


    "Statement"
    the E-Wallet statement showing amounts received from you or paid by you for parking services or session and any charges (including the E-Wallet Service Fee and any other fees payable in respect of its use or closure) and such other information as APCOA Connect may deem appropriate from time to time.


    "Top-Up"
    means a payment made into your E-Wallet in advance of paying for parking services or sessions. This can be a predetermined amount set by you in the settings of your E-Wallet or such additional amount as you decide to pay provided that if the amount in your E-Wallet falls below the Minimum Amount, the amount of the Top-Up will be at least sufficient to restore the balance in your E-Wallet to the Minimum Amount.



  3. When you apply to APCOA Connect for an E-Wallet account, you will be asked to:
    1. indicate your proposed Method of Payment;

    2. provide the necessary details relevant to your proposed Method of Payment to allow it to be used; and

    3. if your proposed Method of Payment is payment by one of the Other Methods, your application must be accompanied by a Top-Up so that the amount in your E-Wallet is at or above higher of the Minimum Balance and your selected Low Balance Level.

  4. You authorise APCOA Connect to deduct any of the Payments and Charges outlined in Section 3 that are due to be paid by you from the funds held in your E-Wallet (including the E-Wallet Service Fee and any other fees payable in respect of its use or closure) as they are incurred. These charges can include charges made for misuse of the E-Wallet facility or the issue of additional statements or reports to you.

  5. When you use the E-Wallet facility (and each time you use it you repeat this confirmation) you confirm that:

    1. You are responsible for ensuring that there are sufficient funds in your E-Wallet to pay the fee for the parking services or session at the rate applicable at the time you park your vehicle.

    2. If there are insufficient funds in your E-Wallet, then you will either

    3. Top-Up your E-Wallet;or

    4. if you do not then it is your responsibility to pay the Parking Fee in some other way (for example in cash or by using some other payment method) at the parking facility in question;

  6. If you decide to cancel or alter your Mandate and do not intend to continue making payments by any of the Other Methods you must tell APCOA Connect within 24 hours of such cancellation, alteration or intention;

  7. You are not entitled to any interest on any sums held in your E-Wallet;

  8. If the balance in your E-Wallet falls below the Low Balance Level, you authorise APCOA Connect to use the payment details you have provided to automatically seek a Top-Up to bring the E-Wallet balance back above the higher of the Minimum Amount and your selected Low Balance Level.
    APCOA Connect may suspend your use of your E-Wallet facility until the balance has been restored to the higher of the Minimum Amount and your selected Low Balance Level.

  9. When your balance goes below the Minimum Balance and you fail to Top-Up you E-Wallet, it remains your responsibility to arrange for a Top-Up to be made. In such circumstances APCOA Connect may send an SMS reminder to you to bring the account back to the level of your Low Balance Level. You authorise APCOA Connect to send such a reminder SMS every two weeks for the first two months and then every month after that until such time as you cancel your E-Wallet or it is successfully restored to your selected Low Balance Level. For each reminder message of this type there is a 20cents charge.

  10. In the event that APCOA Connect sends a reminder SMS as outlined above, then until your E-Wallet is restored to the Low Balance Level, your E-Wallet will be suspended, and you will not be able to use it to pay for any parking services or sessions.

  11. In the event that APCOA Connect sends a reminder SMS as outlined above, then until your E-Wallet is restored to the Low Balance Level, your E-Wallet will be suspended, and you will not be able to use it to pay for any parking services or sessions.

  12. You can close your e-Wallet account at any time by using the smartphone app or online. The Closure Fee will be deducted from your E-Wallet account. Any balance will be refunded to you in accordance with the instructions you give when requesting the cancellation.
